The Department of Homeland Security (DHS) has announced that it will begin accepting applications for the new Parole in Place (PIP) process on August 19, 2024. This program is designed to help noncitizen spouses and children of U.S. citizens obtain legal status while staying in the U.S., promoting family unity and stability.
Eligibility Criteria:
- Be present in the United States without admission or parole.
- Have been continuously present in the United States for at least 10 years as of June 17, 2024.
- Have a legally valid marriage to a U.S. citizen as of June 17, 2024.
- Not have any disqualifying criminal history or pose a threat to national security or public safety.
- Merit a favorable exercise of discretion.
Noncitizen children of qualifying spouses may also be considered if they have a qualifying stepchild relationship with a U.S. citizen as of June 17, 2024.
Next Steps: While applications cannot be submitted before August 19, 2024, DHS advises potential applicants to begin gathering necessary documentation, including proof of marriage, identity, and continuous presence in the U.S. Examples of acceptable documentation include marriage certificates, utility bills, school records, and birth certificates of children born in the U.S.
More detailed information about the application process, required fees, and forms will be provided in a forthcoming Federal Register notice. Applications submitted before the official start date will be rejected.
