Orlando EB-5 Investor Visa Lawyers
The EB-5 Investor Visa program was created to encourage economic growth in the United States by attracting foreign capital. Through this program, foreign investors can earn lawful permanent residency by contributing to the U.S. economy and creating jobs for American workers.
By providing a structured avenue for international investors, the U.S. government is seeking to foster regional development, strengthen communities, and bolster industries in need. The EB-5 program benefits everyone involved--businesses gain access to a critical source of funding, while investors have an opportunity to establish roots in the United States for their families and future endeavors.
While the EB-5 program is an advantageous pathway, successfully navigating its rigorous application process can be challenging. Government agencies require precise documentation, adherence to specific regulations, and evidence of sufficient investment and job creation impact. That’s where we can step in and help.
We can guide you through every stage of the process, from selecting qualifying investment opportunities to compiling essential paperwork and ensuring compliance with all legal requirements. By working with us, you can minimize errors, address potential roadblocks in advance, and improve your chances of a successful application.
The lawyers in our Orlando office have over 15 years of experience helping clients get approval on their EB-5 Investor Visas. Call (407) 598-6035 or contact us online today.
EB-5 Qualification Criteria
To qualify for an EB-5 Investor Visa, applicants and their investment must meet the following requirements:
- Minimum investment: Investors must make a minimum financial investment of $1,050,000, or $800,000 if the business is located in a Targeted Employment Area (TEA), such as a rural region or area with high unemployment.
- A new commercial enterprise: The investment must be in a new commercial enterprise, which is defined as a for-profit business established after November 29, 1990, or a business restructured or expanded in a way that increases net worth or workforce by at least 40%.
- Job creation: The investment must create or preserve at least 10 full-time jobs for U.S. workers within two years of the investor’s admission to the United States on an EB-5 visa.
- Active role in the business: Investors must demonstrate active involvement in the business, which can include day-to-day management or policy formation. Total passivity in the enterprise is not permitted.
- Lawful source of funds: Investors need to provide evidence that the investment funds were obtained through lawful means, such as earnings, business income, or a properly documented loan or gift.
- Sustainability of the investment: The investment must remain at risk throughout the EB-5 process to ensure that it is truly contributing to economic activity.

Targeted Employment Area (TEA) Designations
The TEA designations noted above can play a crucial role in the EB-5 Investor Visa process by identifying regions that would significantly benefit from foreign investment. A TEA is defined as either a rural area or an area with high unemployment, meaning unemployment rates of at least 150% of the national average. These regions are often underserved and in need of economic stimulation.
For EB-5 investors, TEA designations offer a compelling advantage--lowering the minimum investment requirement from $1,050,000 to $800,000. This reduction makes the program more accessible, allowing more investors to participate while directing capital to areas where it is needed most. By choosing a TEA, investors not only save on the financial threshold, but also contribute to meaningful economic revitalization and job creation in struggling communities.
TEA designations encourage balanced development by steering resources into underdeveloped or rural areas. This benefits both investors, who gain access to a streamlined investment pathway, and the U.S. economy, which reaps the rewards of new businesses and job opportunities in regions that need it.
