What Is DACA?

Eligibility for DACA is determined based on specific criteria that applicants must meet. These qualifications are designed to ensure the program benefits individuals who entered the U.S. as children and have built their lives within the country.
Below is a breakdown of DACA’s key eligibility requirements:
- You must be at least 15 years old to apply, unless you are currently in removal proceedings or have a final removal or voluntary departure order, in which case you can apply at any age.
- You must have arrived in the United States before your 16th birthday.
- You must have been under the age of 31 as of June 15, 2012.
- You must have continuously lived in the United States since June 15, 2004.
- You must have entered the United States without inspection before June 15, 2012, or your lawful immigration status must have expired as of that date.
- You must have been physically present in the United States on June 15, 2012, and at the time you submit your DACA application.
- You must be either currently enrolled in school, have graduated from high school, or have obtained a GED (General Educational Development) certificate.
- Alternatively, you may qualify if you honorably served in the U.S. Armed Forces or Coast Guard and were discharged under honorable conditions.
Individuals who apply for DACA must not have been convicted of a felony, significant misdemeanor, or three or more other misdemeanors. Additionally, you must not pose a threat to public safety or national security, as determined by United States Citizenship and Immigration Services (USCIS) officials during the application review process.
