EB-5 Qualification Criteria
To qualify for an EB-5 Investor Visa, applicants and their investment must meet the following requirements:
- Minimum investment: Investors must make a minimum financial investment of $1,050,000, or $800,000 if the business is located in a Targeted Employment Area (TEA), such as a rural region or area with high unemployment.
- A new commercial enterprise: The investment must be in a new commercial enterprise, which is defined as a for-profit business established after November 29, 1990, or a business restructured or expanded in a way that increases net worth or workforce by at least 40%.
- Job creation: The investment must create or preserve at least 10 full-time jobs for U.S. workers within two years of the investor’s admission to the United States on an EB-5 visa.
- Active role in the business: Investors must demonstrate active involvement in the business, which can include day-to-day management or policy formation. Total passivity in the enterprise is not permitted.
- Lawful source of funds: Investors need to provide evidence that the investment funds were obtained through lawful means, such as earnings, business income, or a properly documented loan or gift.
- Sustainability of the investment: The investment must remain at risk throughout the EB-5 process to ensure that it is truly contributing to economic activity.
