A dissolution of marriage may be contested or uncontested. An uncontested dissolution of marriage can proceed if the Husband and Wife can agree as to each and every issue concerning their dissolution. However, if the parties cannot agree as to each and every issue then they must proceed with a contested dissolution of marriage. Every dissolution of marriage action will have various issues which must be either litigated or negotiated between the parties. Some of the issues that may arise are custody, child support, visitation, health insurance, property distribution, the marital home, division of the debt, alimony, domestic violence and others and they must be resolved either by the Court or the parties themselves. When the parties themselves can agree how to decide each and every issue in their case then they may proceed with an uncontested dissolution of marriage. If the parties cannot agree on every issue then the parties must proceed with a contested dissolution. Every case is unique and must be evaluated on an individual basis.
